California Bail Costs

California law sets the bail bond premium at exactly 10% of the bail amount. This is regulated by the California Department of Insurance and cannot be discounted. California bail amounts tend to be among the highest in the nation:

  • Domestic violence: $10,000 - $50,000
  • Drug possession: $5,000 - $25,000
  • Assault/battery: $10,000 - $50,000

The Humphrey Decision: A Game Changer

In 2021, the California Supreme Court's ruling in In re Humphrey fundamentally changed bail in California. The court ruled that:

  • Judges must consider the defendant's ability to pay when setting bail
  • Bail cannot be set at an amount the defendant can't afford if there's no public safety justification
  • Non-monetary conditions of release must be considered as alternatives
