How Bail Works in California

California law sets the bail bond premium at exactly 10% of the bail amount. This is regulated by the California Department of Insurance and cannot be discounted. California bail amounts tend to be among the highest in the nation:
- DUI: $5,000 - $15,000
- Domestic violence: $10,000 - $50,000
- Drug possession: $5,000 - $25,000
- Assault/battery: $10,000 - $50,000
- Burglary: $20,000 - $50,000
The Humphrey Decision: A Game Changer
In 2021, the California Supreme Court's ruling in In re Humphrey fundamentally changed bail in California. The court ruled that:
- Judges must consider the defendant's ability to pay when setting bail
- Bail cannot be set at an amount the defendant can't afford if there's no public safety justification
- Non-monetary conditions of release must be considered as alternatives
